Terms of Service

These Terms of Service (the "Terms") govern the conditions of use of the software tool (the "App") developed by the marketing agency MOVE Agency (the "Company") for automated processing of incoming Instagram Direct messages to the Company's business account using artificial intelligence.
1. General Provisions
By sending a message to the Company's business account on Instagram, the user (the "User") confirms that they have read these Terms and the Privacy Policy and agree to their conditions.
2. Service Description
The App allows the Company's employees to respond faster to inquiries in Direct, using an artificial intelligence model (OpenAI) to draft initial responses in a defined brand style. All automatically provided responses are based on publicly available information about the Company's services and do not constitute a legally binding offer.
3. Conditions of Use
- The User contacts the Company voluntarily within the standard Instagram functionality.
- The User undertakes not to send through Direct any unlawful, abusive, spam, or harmful content.
- The User does not transmit to the Company through the App any confidential information of third parties, payment details, passwords, or document data.
- The User has the right, at any time, to request a switch to manual handling by a human — to do so, send the message "operator" (or «оператор» in Ukrainian) in Direct. The Company will immediately transfer the conversation to an employee with no AI processing.
4. Intellectual Property
All rights to the App, its code, brand style, logos, and other elements belong to the Company. By sending a message, the User grants the Company a non-exclusive, royalty-free license to process such message to the extent necessary to provide a response.
5. Limitation of Liability
The App is provided "as is". The Company makes efforts to ensure that responses are accurate and up to date but does not guarantee the absence of errors in responses generated by artificial intelligence. No information obtained through the App constitutes an official commercial offer or legal, medical, or financial advice. Before making decisions, the User must contact a Company manager.
The Company is not responsible for:
- temporary unavailability of the service due to technical reasons or platform restrictions imposed by Meta;
- actions of third parties (Meta, OpenAI, communication providers);
- consequences of decisions made by the User on the basis of automated responses.
6. Personal Data
Processing of personal data is carried out in accordance with the Privacy Policy.
7. Changes to the Terms
The Company reserves the right to modify these Terms. The current version is always available at this URL. Continued use of the Company's Instagram account after the publication of changes constitutes consent to the new conditions.
8. Governing Law
These Terms are governed by the laws of Ukraine. All disputes are resolved through negotiations, and if no agreement is reached, in court at the Company's place of registration.
